How much is my case worth?
Every case is unique. The value depends on factors like who was at fault, the extent of your injuries, and what insurance coverage is available. Your lawyer will consider your medical bills, lost income, pain and suffering, and how your life has changed due to the injury. As your case progresses and we gather more evidence, we’ll be better able to estimate its value.
If an insurance company denies your claim, there is the possibility of recovering punitive damages as well.

Will my case definitely go to court?
We are trial lawyers at heart, and we work up each case as if it will be tried to a jury. But the truth is that some cases do not need to go to court. Many cases settle through negotiation, without needing to go to trial. But if the insurance company won’t offer fair compensation, we may recommend going to court. If that happens, we’ll prepare you thoroughly and be by your side every step of the way.
How long will my case take?
It depends. If your injuries are still being treated or there’s a dispute about who’s at fault, the case may take longer. Some cases resolve in a few months, but others—especially those that go to court—can take a year or more. We’ll keep you updated at every step and explain what’s happening behind the scenes so you’re never left in the dark. The more we know about your case, the better estimate we can give you about how long it could last.
What does it cost to hire a personal injury lawyer or an insurance bad faith lawyer?
Most personal injury and insurance bad faith lawyers, including us, work on a contingency fee. That means you pay nothing upfront—we only get paid if we win money for you. The fee is typically a percentage of the recovery, and we’ll explain all of this clearly in our agreement before we start your case.

Does Ruiz & Smart handle cases on a contingent fee?
Yes, we handle most cases (including personal injury and insurance bad faith cases) on a contingent-fee basis. A contingent fee is when a lawyer only gets paid if they successfully recover money for their client through a settlement or court verdict. Instead of charging an hourly rate or a flat fee, the lawyer takes a percentage of the client’s recovery. If the case is lost, the client does not owe the lawyer any legal fees. Contingent-fee agreements are the industry standard in personal-injury cases.
